Avatar means the character used by the User (with or without features that can be obtained within the game environment) and its entire set of virtual accessories in the digital environment, used by the User within the game. Avatar may also mean the image and display name chosen by the User.
User Account refers to all the personal information required by the user to access the services of the websites.
Game ID means a combination of numbers and letters that the User must create to identify themselves and gain access to the games. The Game ID is linked to the User Account, and multiple Game IDs can be created for each User Account.
Password means a combination of letters and numbers that the User must create to ensure that only they will use their User Account and Game ID.
Brabos Coin refers to the universal virtual currency used in microtransactions to acquire virtual items from all the games provided by Brabos Club.
Virtual Goods means virtual items created or obtained within the virtual environment of the online games provided by Brabos Club to be used by avatars or characters inhabiting these cyber spaces.
Virtual Donation Store means the transaction of Virtual Goods, which can generally be obtained for free in the game and also through donations made between Users and Brabos Club.
PagSeguro means a company of the UOL Group that offers a complete solution for online payments, ensuring the security of buyers and sellers on the web. Those who buy with PagSeguro are guaranteed that the product or service is delivered, or they get their money back. Those who sell with PagSeguro are protected against fraud and losses in online sales. Those who integrate stores with PagSeguro have access to tools, commissions, and free advertising.
PayPal means an online payment solution, similar to PagSeguro, that works on the virtual wallet (e-wallet) model and allows payments via credit card, bank accounts, PayPal Smart Connect, or account balances, without revealing financial information.
Mercado Pago means an online payment solution, similar to PagSeguro, that operates on the virtual wallet (e-wallet) model and allows payments via credit card, boleto, PIX, etc.
Services means the use of the game client software made available by Brabos Club, subject to acceptance of specific licenses, the transaction of the virtual currency Brabos Coin, the sale of virtual items from the games made available, and other real products and services made available or that may be made available through the websites.
These Terms of Use cover the entire Agreement between Brabos Club and the User, and this instrument replaces any previous agreements between Brabos Club and the User regarding its subject matter, without prejudice to other instruments that may govern a different scope from these Terms of Use, made available in writing by Brabos Club. This Agreement does not override additional terms and conditions that Brabos Club notifies the User of and that may apply when using third-party content or services.
The clauses of these Terms of Use may be modified and updated at any time by Brabos Club.
Brabos Club may modify or revise these Terms of Use at any time at its sole discretion. Such amendment or revision will become effective upon the posting of the revised Terms of Use on the Websites and will take effect immediately thereafter.
The continued use of the services by the User after the posting of the revised Terms of Use will be considered as tacit acceptance of such changes.
The User must complete a registration form containing a valid email account and password.
The User agrees to provide truthful, accurate, and complete information about themselves in the registration form, as well as in any other form presented on Brabos Club's Websites.
Brabos Club declares and the User agrees that it has no obligation to verify the accuracy of the information transmitted by Users or any other person. Thus, the parties agree that the content of the information or messages sent through this registration is the sole responsibility of the sender, with Brabos Club being exempt from any responsibility for the consequences of these messages.
The User acknowledges and agrees that Brabos Club may refuse to grant a username, display name, or Avatar image that is already in use, that may be (i) illegal, (ii) protected by image rights, trademark, and/or other rights, (iii) obscene or profane, and/or (iv) considered inappropriate by Brabos Club at its sole discretion.
The User agrees to be responsible for all acts and omissions that occur in connection with their Password and PIN. The User undertakes to maintain the confidentiality of the Password and PIN and to notify Brabos Club if they believe they have been compromised or breached. The User is aware that Brabos Club does not protect them against unauthorized use of their Password and PIN.
Likewise, the User agrees to be responsible for all acts and omissions that occur in connection with their Password and is aware that Brabos Club does not protect them against the misuse of their Password for illicit conduct, regardless of whether it was carried out by third parties in possession of their shared Game ID, whether voluntarily or not.
BRABOS CLUB WILL NOT BE RESPONSIBLE IF THE USER ACCOUNT PASSWORD, GAME ID PASSWORD, OR PIN IS DISCLOSED AND/OR PROVIDED TO ANY THIRD PARTY, SOLELY AND EXCLUSIVELY DUE TO THE USER'S FAULT AND DISCRETION.
BRABOS CLUB WILL NOT BE RESPONSIBLE FOR THE SECURITY OF CONNECTIONS WHEN MADE OUTSIDE OF ITS WEBSITES AND DOMAINS OR WHEN IT SOLELY DEPENDS ON THIRD-PARTY SERVICES.
IN THE EVENT OF LOSS, THEFT, OR MISPLACEMENT OF THE PASSWORD OR PIN, OR IN THE EVENT OF ANY TECHNICAL PROBLEM IN USING THEM, THE USER MUST IMMEDIATELY REPORT THE INCIDENT TO BRABOS CLUB THROUGH THE ONLINE SUPPORT CENTER, OFFERED ON OUR DISCORD, FOR THE IMMEDIATE SUSPENSION OF ACCESS TO THE RESPECTIVE ACCOUNT AS A SECURITY MEASURE.
4.9.1. Brabos Club reserves the right to monitor, record, store, and analyze any and all actions performed by the user during the use of the games and systems, including but not limited to: internal communications (private, party, clan, or public messages), character movements, executed commands, interactions with NPCs, trades, exchanges, item acquisitions, connections, access attempts, login/logout records, and other behaviors within the game environment.
4.9.2. The purpose of this monitoring is to ensure the security and integrity of the community, prevent fraud, detect cheating, curb abusive or irregular behavior, verify compliance with the Terms of Use, and preserve the fairness and stability of the virtual environment.
4.9.3. By using our services, the user acknowledges and agrees to these practices, expressly authorizing the recording and analysis of their activities within the games and systems for the purposes set forth in this clause.
The User will be responsible for the use of the Services on the Websites provided under the terms of this agreement, observing all applicable and current national, state, and municipal laws, decrees, and regulations, as well as the Security and Privacy Standards published and disclosed by Brabos Club, contained on the Websites.
The User will be solely and exclusively responsible for maintaining the machine settings for access to the services contracted herein, being prohibited from changing the machine's addresses, the network's IP (Internet Protocol), or the email, in an attempt to hold third parties responsible or to hide their identity or authorship.
In the event of the cases mentioned herein, Brabos Club may make all information about the User available to competent authorities at any time, as well as automatically cancel their account without prior notice, and the User will be civilly and criminally liable for the acts performed.
The User will be solely and exclusively responsible, civilly and criminally, for the use and/or destination of the Brabos Coins and Items from the Donations Store that they may acquire through the Services on the Websites.
Brabos Club in no way agrees, endorses, or supports the use/destination of the Items from the Brabos Coin and Donations Store by the User, nor does it control or supervise, on its own initiative, the use and destination of these items by the User. However, without prejudice to the right to terminate this Agreement, Brabos Club may, at any time and at its discretion, partially or completely suspend the User's access to the Services if the User has used them contrary to the applicable legal regulations, this Agreement, or the terms and conditions of service use.
The User will be solely responsible for the amounts and payment methods they choose in relation to the acquisition of Brabos Coins and Items from the Donations Store, as well as for all costs and expenses arising from the use of the Services.
The User also declares to be aware that additional charges may apply to Brabos Coins, Items from the Donations Store, and the use of the Services, depending on the payment method chosen by the User, which will be previously informed by Brabos Club.
The User agrees to indemnify, defend, and hold harmless Brabos Club and its subsidiaries and affiliates, as well as their respective officers, directors, shareholders, employees, agents, service provider clients, clients, and contractors, from any loss, claim, demand, costs, or expenses (including legal fees and costs) claimed by any third party as a result of the User's use of the Services, violation of these Terms of Use, or violation of any rights of any other User, directly or indirectly.
In the event of any third-party claims that may affect Brabos Club and/or even include it as a defendant in a lawsuit, the User hereby agrees to request the exclusion of Brabos Club from the respective lawsuit, assuming full responsibility in the respective action.

The download of registered material by the User from Brabos Club is expressly allowed for the User's use of the services offered on the Websites.
All and any content submitted (for example, through upload or publication) via the Services will be considered the property of Brabos Club from the moment of upload or publication.
Brabos Club will hold the intellectual property rights over all user-generated content for an indefinite period and may use, reproduce, alter, adapt, publish, transmit, license, post, sell, translate, and create derivative works for any purpose, including, but not limited to, commercial purposes, without any compensation, remuneration, or credit for the author of the content.
You agree to waive and forfeit any intellectual property rights over the content generated and submitted through the Services, including, but not limited to, moral rights, privacy rights, publicity rights, and credit rights for the material or ideas submitted in the future.
The User agrees and guarantees not to create or publish illegal content that infringes on the rights of others or damages the reputation of the games and Brabos Club.
The User agrees that any other user and Brabos Club may photograph (snapshot), capture images, film, and record videos of their character in the games within the virtual game environment and grants the right to use the material, royalty-free, to be used, reproduced, distributed, transmitted, or modified in all types of media.
THE USER ACKNOWLEDGES AND AGREES THAT BRABOS CLUB AND/OR ITS PARTNERS WILL NOT ASSUME OR BE RESPONSIBLE FOR ANY ACTIONS BY BRABOS CLUB AND/OR ITS CONTENT PROVIDERS OR OTHER LICENSEES REGARDING THE CONDUCT, COMMUNICATION, OR CONTENT OF THE SERVICES.
BRABOS CLUB WILL NOT BE RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, EXEMPLARY, OR CONSEQUENTIAL DAMAGES, INCLUDING, BUT NOT LIMITED TO, LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF BUSINESS INFORMATION, OR ANY OTHER PECUNIARY LOSS IN CONNECTION WITH THE SERVICES OR ANY PRODUCT PROVIDED BY BRABOS CLUB.
THE USER AGREES THAT BRABOS CLUB CANNOT BE HELD RESPONSIBLE FOR ANY EVENT THAT OCCURS OR RESULTS FROM ACCESS TO THE SERVICES DUE TO FORCE MAJEURE OR ACTS OF GOD BEYOND THE ACTION, OMISSION, OR WILL OF BRABOS CLUB.
Personal information provided by the User to Brabos Club during registration will be used solely and exclusively for our internal purposes. The information collected will be used to find out what pleases the User and to improve the Services.
Except in cases previously and expressly permitted by these Terms of Use, or otherwise expressly authorized by the User, Brabos Club will not provide third parties with any personal data provided by the User.
Brabos Club does not guarantee the security of any of our private transmissions against interception or unauthorized or unlawful access by third parties to the User's connection.
Brabos Club may disclose any information provided by the User to private or public entities, law enforcement agencies, or government officials to the extent that Brabos Club, at its sole discretion, deems it necessary to investigate, resolve potential issues, or as required by law and/or a court order.
The User will only be known and identified in the games through their Character Name(s). Any disclosure of their username or real identity is the sole and exclusive responsibility of the user.
To ensure the proper functioning of the Games, the User expressly authorizes Brabos Club to disclose their Character Name(s) on the Websites in the event of the application of any of the penalties provided for the Games, as well as for participation in rankings, events, promotions, etc.
Upon request for any technical support, the User consents to access by Brabos Club and/or another third party expressly authorized by Brabos Club, as well as the remote review of the computer for the purpose of downloading the Software for support and virus removal purposes.
The User and Brabos Club will communicate through the Online Support Center located on Brabos Club's Discord via a ticket for any purpose related to the Services, the Software, and any service or software that may be provided by Brabos Club and/or on behalf of Brabos Club in the future, in accordance with the service policy contained on the Websites.
The Privacy Policy is described in a specific section of the Brabos Club portal (https://brabos.club) and on the game websites made available by it.
The Online Support Center operates through a ticket system on the Brabos Club Discord.
Service tickets function as a protocol for requests, allowing interaction with assistants to complement information or data and send documents when necessary, as well as enabling clients to track the service until its resolution, eliminating the need to submit new requests.
The restoration of game items, provided they have not been transferred to another user's inventory, will depend on the analysis of players' actions in the game (logs) and will only be possible in cases resulting from system failures or accidental loss or sale to non-player characters (NPCs).
In-game item transactions between players cannot be canceled, nor will the exchanged items be restored to their pre-transaction state through the Online Support Center.
The restoration of game characters, based on the confirmation of registration data and analysis of players' actions in the game (logs), will only be possible in cases resulting from system failures.
The restoration of game items and characters will not be possible when their loss results from sharing the User Account Password or Game ID Password with a third party, solely and exclusively due to the user's fault and discretion.
In accordance with points 4.7 and 4.8, the restoration of game items and characters will not be possible when their loss results from fraud.
The restoration of game characters may require the modification of the character's name to be restored, as character creation is highly dynamic and characters with the same name are not allowed. In this case, the name of the character to be restored will be modified at the discretion of the Online Support Center team, usually by adding a number to the name of the character that is no longer available.
The Online Support Center is not responsible for any damages resulting from the illegal practice of sharing accounts, characters, or game items with other users.
The Online Support Center is not responsible for damages resulting from cheating, hacking, or fraud, but will make every effort to punish those responsible and minimize the damage, within reasonable limits, to affected players.
The Brabos Club Virtual Donation Store uses PagSeguro, PayPal, and Mercado Pago to process transactions through various payment methods, such as bank slips, online debit, account deposits, credit cards, debit cards, PIX, and others.
In the future, other payment methods and accredited donation channels will be made available, and the Donation Store policies will be adapted for each payment method adopted by Brabos Club.
If the User is under 18 (eighteen) years of age, the purchase of credits in Brabos Coin must be carried out jointly and in the presence of parents and/or guardians.
The User must inform Brabos Club of any potential issues with accredited sales channels, and Brabos Club commits to making its best efforts to prevent any harmful practices by third parties.
The User agrees that Brabos Club cannot be held co-responsible for the acts of authorized resellers carried out in a manner different from what was indicated by Brabos Club.
Brabos Club recommends that Users check the Websites for each purchase to verify that the place of purchase is indeed an authorized distribution channel.
In PagSeguro, once the transaction is initiated, the User must choose the payment method: bank slip, online debit, account deposit, credit card, or debit card.
Once payment is made using the chosen method, the transaction will be analyzed by PagSeguro.
The transaction will be approved by PagSeguro only after the payment has been processed.
The approval of the transaction by PagSeguro generally occurs shortly after the payment is processed. However, the review and processing time for the transaction may vary depending on the selected payment method.
Upon approval of the transaction by PagSeguro, when the transaction status is "Approved," the Brabos Coin credits corresponding to the purchased amounts will be delivered to the account registered on the Brabos Club portal, through which the transaction was made.
PayPal and Mercado Pago provide faster approvals of value transfers due to the payment methods they offer.
Brabos Coin credits can be used for all Game IDs made available by Brabos Club, which are associated with the User Account and are used to purchase items, products, or services from the Donation Store in online stores or in-game stores on the Websites.
In case of malfunctioning items purchased in the games, provided that the defect is demonstrated through the analysis of player action logs, they may be exchanged or returned.
13.1 The provision of services will be carried out through the availability of Brabos Coin credits in favor of the User. The use of benefits represented by Brabos Coin credits on the Game Websites will always depend on a positive balance of Brabos Coin credits in favor of the User, i.e., a sufficient balance for the acquisition of the benefits desired by the User.
14.1O The User acknowledges that the Internet, as a global network accessible to anyone, is not a completely secure medium.
14.2 To mitigate risks, as a matter of goodwill, Brabos Club will provide technical resources aimed at avoiding or mitigating the inherent risks of the Internet.
14.3 However, in the case of using the Website via the Internet, Brabos Club will not be responsible under any circumstances for any damages or losses, including but not limited to, those resulting from the disclosure of information to third parties or data loss, directly or indirectly resulting from the use of the Websites, caused to the User.
14.4 YOU EXPRESSLY AGREE THAT THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" AND THAT YOU USE THE SERVICES AT YOUR OWN RISK. BRABOS CLUB EXPRESSLY DISCLAIMS LIABILITY FOR INTELLECTUAL PROPERTY INFRINGEMENT OR OTHER RIGHTS VIOLATIONS WHEN THE USER MISUSES THE WEBSITES.
14.5 THE USER DECLARES, ACKNOWLEDGES, AND AGREES THAT (I) THE CURRENT STATE OF THE ART DOES NOT ALLOW FOR THE DEVELOPMENT OF COMPUTER PROGRAMS COMPLETELY FREE OF FAULTS OR DEFECTS, AND THEREFORE, BRABOS CLUB CANNOT GUARANTEE THAT THE WEBSITES WILL FUNCTION UNINTERRUPTED OR FREE OF FAULTS OR DEFECTS; AND (II) THE WEBSITES HAVE NOT BEEN DEVELOPED AT THE USER'S REQUEST, BUT FOR GENERAL USE, SO BRABOS CLUB CANNOT GUARANTEE THAT THEY WILL MEET THE SPECIFIC NEEDS OF USERS.
14.6 BRABOS CLUB will make its best efforts to provide the User with high-quality and high-performance service. However, given that the provision of Services depends on regular Internet connectivity, the telecommunications means used, and the User's own equipment, among other variables, the User acknowledges and agrees that BRABOS CLUB does not provide any guarantee of quality and/or functionality of the Services and does not guarantee that these Services will be obtained successfully.
14.7 BRABOS CLUB MAKES NO REPRESENTATION OR WARRANTY REGARDING THE RESULTS THAT MAY BE OBTAINED FROM USING THE SERVICES, THAT THE RESULTS FROM SUCH USE WILL BE RELIABLE OR ACCURATE, OR THAT THE QUALITY OF ANY PRODUCT, SERVICE, INFORMATION, OR OTHER MATERIALS PURCHASED OR OBTAINED BY THE USER THROUGH THE SERVICES WILL MEET THEIR PARTICULAR EXPECTATIONS.
14.8 YOU UNDERSTAND AND AGREE THAT ANY MATERIAL AND/OR OTHER DATA OBTAINED THROUGH DOWNLOAD AND OTHERWISE THROUGH THE USE OF THE SERVICES IS DONE AT YOUR SOLE DISCRETION AND RISK. YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR DATA LOSS RESULTING FROM THE DOWNLOAD OF SUCH MATERIALS OR DATA.
14.9 NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED FROM BRABOS CLUB OR THROUGH THE SERVICES, WILL CREATE ANY WARRANTY THAT IS NOT EXPRESSLY STATED IN THESE TERMS OF USE.
15.1 To ensure good relations between the User and the gaming communities, Brabos Club will not allow the User to engage in Unacceptable Conduct described in the Server Rules. In this case, Brabos Club reserves the right to apply the appropriate penalties in accordance with the Penalty Table and Server Rules.
15.2 Brabos Club may change or include new Unacceptable Conduct, always for the benefit of the game. Any changes or additions will be communicated to the User through the Websites.
15.3 Brabos Club reserves the right to review and remove all content, messages, or other communications that it considers to be the result of Unacceptable Conduct, and it is up to Brabos Club to judge what is considered offensive, illegal, or infringing on rights, or that harms or threatens the safety of another User.
15.4 In the case of engaging in any Unacceptable Conduct, in addition to applying the corresponding penalties to the User, Brabos Club may disclose the User's registration data to police, administrative, or judicial authorities if the User's actions violate the laws of the Federative Republic of Brazil or the rights of interested third parties.
15.5 The User shall not engage in any illegal conduct or communication while using the Services that restricts or inhibits any other User from using or enjoying the Services. The User agrees to use the Services only for lawful purposes.
15.6 The Unacceptable Conduct is described in the Server Rules, which govern disciplinary issues for the game, the Forum, social networks, and all other official communication channels for each game provided by Brabos Club.
15.7 The User declares to be aware of and accept the penalties outlined in the Server Rules.
16.1 Brabos Club reserves the right to interrupt the Services from time to time, periodically or not, with prior notice, to carry out maintenance tasks.
16.2 The User is aware that Services may be interrupted due to reasons beyond Brabos Club's control, and in such cases, Brabos Club cannot guarantee that the User will always be able to access the Services when desired.
16.3 Brabos Club is not responsible for any interruption, delay in service, or inability to provide the service due to causes beyond its control, unforeseen events, or force majeure.
17.1 These Terms of Use are indefinite, effective on the date of electronic acceptance. Either party may immediately cancel the User's account at any time during the term with express prior notice to the other party.
17.2 The User may cancel their account at any time by expressly contacting Brabos Club's Online Customer Support Center.
17.3 Brabos Club and the User expressly agree that communications related to the cancellation of the User's account on the Brabos Club portal, for reasons not attributable to the User, will only take effect once all available Brabos Coin credits in the User's favor have been exhausted.
a) by either party, in the event of non-compliance by the other party with the provisions of this Agreement that prevent the continuation of its execution;
b) by Brabos Club, if the User in any way damages the public image of Brabos Club and/or any company associated with Brabos Club in providing the Services;
c) by Brabos Club, if the User engages in illegal practices, violates public order, morals, good customs, or even the security and privacy policies, and Brabos Club's usage terms.
17.5 In case of termination of this Agreement for any reason, the User agrees to settle and immediately pay any outstanding debts and matters related to Services already provided and not yet paid, if applicable.
17.6 The termination of the service agreement, for any reason, will result in the loss of valid, unused credits in favor of Brabos Club.
18.1 Any delay by Brabos Club in exercising its rights or enforcing the User's obligations under this document will not constitute a waiver or abandonment of these or any other rights under this Agreement.
18.2 If a court of competent jurisdiction determines that any provision of these Terms of Use is invalid, the parties agree that such court will strive to enforce the intentions of the parties as reflected in that provision, and that the remaining provisions of these Terms of Use will remain in full force and effect.
18.3 These Terms of Use and the relationship between the User and Brabos Club will be governed and interpreted in accordance with the laws of Brazil, and the parties agree to submit to the jurisdiction of the courts in Brazil.
18.4 Brabos Club reserves the right to terminate the operations of any Game due to a government or judicial decision that mandates its discontinuation and/or due to force majeure, beyond Brabos Club's control. In this case, the User will not be entitled to a refund of Brabos Coin credits.
18.5 Brabos Club reserves the right to cease operations of any Game. In this case, Brabos Club will send notice to the User at least thirty (30) days in advance.
18.5.1 The User must consume the Brabos Coin credits they have before the closure of the Game's operations. If not, they will be considered expired after the communicated period, and the User will not be entitled to compensation.
18.6 These Terms of Use, along with the Privacy Policy and any separate written or online agreement between the User and Brabos Club, constitute the entire and exclusive agreement and prevail over any prior agreements between the User and Brabos Club.
19.1 It is well known that a very small percentage of individuals may experience epileptic seizures when exposed to certain patterns produced by flashing lights, certain types of noises, prolonged reading, sleep deprivation, fatigue, hypoglycemia (low blood sugar), etc. Exposure to certain patterns in computer games or video games can trigger a seizure in these individuals. Furthermore, certain circumstances can induce epilepsy symptoms even in people who have no history of epilepsy outbreaks.
19.2 If the User or any member of their family has epilepsy, consult a doctor before playing.
19.3 The User must stop playing IMMEDIATELY and consult a doctor if experiencing symptoms such as: absence seizures, perception distortions, uncontrolled movements of a body part, sudden fear, dizziness, double vision, visual disturbances, muscle contractions, fainting, mental confusion, loss of consciousness, and/or seizures.
a) Avoid playing if tired or sleep-deprived;
b) Avoid playing if tired or sleep-deprived;
c) Play in a well-lit environment;
d) Take breaks of 10 (ten) to 15 (fifteen) minutes every 1 (one) hour of play;
e) Do not play for periods longer than 2 (two) hours per day.
20.1 The chosen court to resolve any disputes arising from these Terms of Use will be the District of Balneário Camboriú, State of Santa Catarina, Brazil.
